Rogers indicted for sexual crimes against child

Harold Wayne Rogers, 38, of Bucksville Road in Auburn, was indicted Sept. 30, 2016, on several counts of crimes in the sexual nature of a child under the age of 12. He was later arrested on those charges.

According to the Grand Jury, Rogers was indicted on one count for crimes occurring on or between Jan. 1, 2004, and Dec. 31st, 2010, in Logan County knowingly and unlawfully committing rape in the first degree in a continuing course of conduct when he engaged in sexual intercourse with a juvenile who is incapable of consent because she was less then 12-years-old and when he engaged in sexual intercourse at least two times in a continuing course of conduct.

Rogers is being charged with rape in the first degree, victim under 12 years of age.

According to the Grand Jury, Rogers was indicted one count for crimes occurring on or between Jan. 1, 2004, and Dec. 31st, 2010, in Logan County knowingly and unlawfully committing the offense of sexual abuse in the first degree in a continuing course of conduct when being 21-years-old or more, he subjected another person who as less than 12-years-old to sexual conduct when he touched the juvenile in a sexual manner at least two times in a continuing course of conduct.

Rogers is being charged with sexual abuse in the first degree, victim under 12 years of age.

According to the Grand Jury, Rogers was indicted on one count for crimes occurring on or between Jan. 1, 2004, and Dec. 31st, 2010, in Logan County knowingly and unlawfully committing sodomy in the first degree in a continuing course of conduct by engaging in deviate sexual intercourse with another person by forcible compulsion, or with another person who is incapable of consent because she is less than 12-years-old, when he had the juvenile perform oral sex on him when she was less than 12-years-old at least two times in a continuing course of conduct.

According to the Grand Jury, Rogers was indicted on one count for crimes occurring on or between Jan. 1, 2004, and Dec. 31st, 2010, in Logan County knowingly and unlawfully committing sodomy in the first degree in a continuing course of conduct by engaging in deviate sexual intercourse with another person by forcible compulsion, or with another person who is incapable of consent because she is less than 12-years-old, when he performed oral sex on a juvenile when she was less than 12-years-old at least two times in a continuing course of conduct.

Rogers is being charged with two counts of sodomy in the first degree, victim under 12 years of age.

According to the Grand Jury, Rogers was indicted on one count for crimes occurring on or between Jan. 1, 2004, and Dec. 31st, 2010, in Logan County knowing the person to be a minor or having possession of such facts that he should reasonably know that such a person is a minor, and with knowledge of the content and character of the material, he exhibited pornographic videos to the juvenile.

Rogers is being charged with distribution of obscene matter to minors first offense.

According to the Grand Jury, Rogers was indicted on one count as a persistent felony offender in the second degree being over the age of 21 and having previously been convicted of the following felony:

Rogers is scheduled to be arraigned Oct. 20 at 8:30 a.m. in Logan Circuit Court.

The function of the Grand Jury is to determine whether there is sufficient competent evidence to believe that a crime has been committed by a specific individual. This does not mean those individuals are guilty of a crime. The innocence or guilt is finally determined by a petit jury at trial.
